The Federal High Court in Abuja's July 7, 2022 decision to remove Delta Speaker Sheriff Oborevwori as the Peoples Democratic Party's (PDP) nominee for governor in the next election was overturned on Monday by the Court of Appeal in Abuja.
The Federal High Court was denied jurisdiction to hear David Edevbie's lawsuit because the cause of action had not yet crystallised at the time the lawsuit was filed, according to a three-member panel of the appellate court chaired by Justice Peter Ige.
The appellate court further determined that Edevbie had not provided sufficient evidence to support his claim that Oborevwori had provided forged and falsified academic credentials and other documents to the Independent National Electoral Commission (INEC) INEC in order to support his eligibility for the governorship election.
It added that Justice Taiwo Taiwo (now retired) who delivered the July 7, 2022 judgment, erred when he upheld Edevbie’s claims after finding that the cause of action has not crystallised because Oborevwori’s name was not yet submitted to INEC and published.
