The Academic Staff Union of Universities (ASUU) has been given permission by the Court of Appeal to challenge the National Industrial Court's decision ordering the union to end its strike.
However, the court allowed the application under the condition that the union abides by the lower court's decision and ends the strike right away while the substantive lawsuit is being decided.
ASUU was given seven days by the court to file the appeal.
According to reports, the National Industrial Court ordered ASUU to end the strike on September 21.
The Federal Government's motion on notice asking for the instructors to return to the classrooms was allowed by the court.
Ruling on the interlocutory injunction, the trial judge, Justice Polycarp Hamman, restrained ASUU from continuing with the industrial action pending the determination of the suit filed against ASUU by the Federal Government.
Miffed by the ruling, the union headed to the appellant court to appeal the ruling.
