The Lagos State Sexual Offenses and Domestic Violence Court in Ikeja has remanded Dr. Femi Olaleye, Medical Director of Optimal Cancer Care Foundation, to Ikoyi Correctional Center until the completion of his bail requirements.
In court, Dr. Olaleye was charged with two charges of sexual assault and defiling by penetration against his wife's niece, age 16.
He pleaded not guilty after the charge was read to him.
His lead attorney, Mr. Babatunde Ogala (SAN), requested the court to grant bail on "liberal terms" in a bail application dated November 24 and submitted on November 25.
Mr Ogala argued that the defendant would be unproductive in prison because his cancer patients looked up to him.
The defendant, he said, came voluntarily after being served with the process and should be given bail if the court deems it appropriate.
In his counter affidavit filed on November 28, the Director of Public Prosecution (DPP), Dr Babajide Martins, argued that the nature of the charge merited the maximum penalty of life in prison.
According to Dr Martins, the actual complainant was the defendant’s first wife, while the nominal complainant was the wife’s niece.
After the defence adopted the bail application and the prosecution filed counter-affidavits, Justice Ramon Oshodi granted the defendant bail for fifty million naira, with two sureties in the same amount.
The judge ordered the sureties to submit the original property documents to the chief registrar of the court, proving that they owned real estate in Lagos.
In addition, he instructed the defendant to hand over all his passports to the court’s chief registrar, including his British, Nigerian, and others.
The judge also directed the court audile to confirm the sureties’ residential addresses.
So, the trial won’t start until December 19, when it was postponed.
