The opposition People's Democratic Party (PDP) challenged candidates for the APC National Assembly seat in Rivers, claiming that the party's primaries leading up to their election were in violation of the 2021 Electoral Act.
The case, however, is thrown out for lack of jurisdiction.
In a quick decision that lasted less than five minutes, Justice Mohammed declared that the Court of Appeal's rulings, in this case, are conclusive and provide good cause to dismiss the lawsuit.
No associated costs were imposed on the interfering Plaintiffs.
No political party, not even the current administration, has the right to meddle in another party's internal affairs, including the method used to choose its candidates.
No lower court may accept or decide such a case, the Court of Appeals added.
In light of this decision, the PDP's other lawsuits filed in Rivers State to bar candidates from the opposition party from running in the upcoming elections are doomed to fail.
In response to the decision, Sogbeye C. Eli, the APC spokesman, said that the Rivers PDP's scheme to prevent APC participation in the 2023 election and the right to field candidates by depriving Rivers people of their constitutional freedom of choice to elect their representatives had failed.
