The Supreme Court has confirmed Adamu Aliero's selection as the Peoples Democratic Party (PDP) candidate for the Kebbi central senatorial constituency in the 2018 national assembly elections.
On Monday, the supreme court's bench of four judges overturned the decision of the lower court.
The Sokoto appeals court invalidated Aliero's candidature on September 28, 2022, and Saidu Haruna was subsequently recognised as the real Kebbi Central candidate.
Aliero's appeal, according to Centus Nweze, a justice on the supreme court, "is fraught with merit and is consequently allowed."
"The judgement of the lower court, which pronounced Saidu Haruna as the winner of the Kebbi central senatorial district primary election is now set aside," Amina Augie, who read the lead decision, stated.
The presiding judges noted that on June 9, 2022, the appellant ran in and defeated the first respondent (Haruna) in the primary rerun election for Kebbi Central.
Due to his participation in the repeat, the Supreme Court determined that Haruna had given up his right to appeal.
The court determined that by taking part in the rescheduled primary, Haruna, the first respondent, "withdrew his petition against the conduct of the May 24, 2022, primary election."
The People's Democratic Party candidate was declared by the Supreme Court to be Yahaya Abdullahi for the Kebbi north senatorial district.
On September 28, the appellate court ruled against Abdullahi's candidature and in favour of Sani Argungu; as a result, on October 2, he appealed to the supreme court, which, after analysing the matter, determined that the lower court lacked jurisdiction.
According to their decision, the lower court lacked the authority to hear the case.
“Judgment is hereby entered in favour of the appellant.
“Judgment of the court below is thereby set aside.”
