Justice Fatun Riman overturned the ruling, stating that the Originating Processes were not served on the IGP, as required.
The court had previously declared Baba's continued stay in office after reaching the retirement age as unlawful, ordering the former President, Muhammadu Buhari, to convene a meeting to appoint a new IGP.
Dissatisfied with the verdict, the IGP filed an application to set aside the judgment, citing lack of service and jurisdiction. The plaintiff, however, argued against the application, asserting that the need for personal service was already waived.
In the ruling, Justice Riman held that the originating processes were not served on the IGP and set aside the previous judgment.
