Justice Haruna Tsammani, presiding over the case, passed down the judgment, stating that the petitioners had "evidently failed" to establish their case as required by Section 137(1)(d) of the Nigerian Constitution.
The crux of the matter revolved around the petitioners' inability to prove that the allegations against Bola Tinubu in the United States District Court, Northern District of Illinois, Eastern Division, amounted to a criminal case. Justice Tsammani clarified that Tinubu had not been arraigned, had not entered a plea, and had not received any sentence of imprisonment in connection with the forfeiture of the $460,000.
